Policy on Cookies

What are cookies:

Cookies are small text strings that the sites visited by the user send to their terminal (usually to the browser), where they are stored to be retransmitted to the same sites on the next visit of the same user.

During the navigation on a site, the user can receive on his terminal also cookies that are sent from different sites or Web servers (C.D. “Third parties”), on which some elements can reside (such as images, maps, sounds, specific links to pages from other domains) on the site that the same is visiting.

The cookies, usually present in users ‘ browsers in very high numbers and sometimes even with characteristics of extensive temporal persistence, are used for different purposes: execution of computer authentication, monitoring of sessions, Storing information about specific configurations regarding users accessing the server, etc.

In order to achieve a correct regulation of these devices, it is necessary to distinguish them ‑ the place that there are no technical characteristics that differentiate them from each other ‑ precisely on the basis of the purposes pursued by those who use them.

In this direction, however, the same legislator has moved, which, in implementation of the provisions contained in Directive 2009/136/EC, has led to the obligation to acquire prior and informed consent of users to the installation of cookies used For purposes other than purely technical (cf. Art. 1, paragraph 5(a) of D. Legislative decree. 28 May 2012, N. 69, which amended the art. 122 of the Code). In this regard, and for the purposes of this measure, two macro-categories are therefore identified:

Technical cookies.

Technical cookies are those used for the sole purpose of “transmitting a communication on an electronic communication network, or to the extent strictly necessary to the provider of a service of the information society explicitly Requested by the Subscriber or the user to provide such service “(cf. Art. 122, paragraph 1, of the code). They are not used for further purposes and are normally installed directly by the owner or website manager. They can be divided into navigation or session cookies, which guarantee the normal navigation and fruition of the website (allowing, for example, to make a purchase or authenticate to access reserved areas);

Cookie analytics, assimilated to the technical cookies where used directly by the site manager to collect information, in aggregate form, on the number of users and how they visit the site; Feature cookies, which allow the user to navigate according to a set of selected criteria (for example, the language, the products selected for purchase) in order to improve the service rendered to the same. For the installation of such cookies the prior consent of the users is not required, while the obligation to give the informative according to art. 13 of the code, that the site manager, if you use only such devices, will be able to provide you with the methods you deem most appropriate.

Profiling cookies.

Profiling cookies are designed to create user profiles and are used in order to send advertisements in line with the preferences expressed by the same in the field of network browsing. Due to the particular invasiveness that such devices may have within the privacy of users, the European and Italian regulations stipulate that the user should be adequately informed about their use and thus express their Valid consent.

They refer to the art. 122 of the code where it provides that “the storage of information in a contractor’s or user’s terminal equipment or access to already archived information is only permitted on condition that the contractor or the user has expressed his or her Consent after being informed in the simplified manner referred to in art. 13, paragraph 3 “(art. 122, paragraph 1, of the code).
